France's Stablecoin Swap Tax Is the Post-MiCA Blueprint Nobody Voted For

CredLion

We didn't see it coming through the front door. It arrived through a budget annex โ€” the way most rules that shape our lives actually arrive.

In mid-October, the French National Assembly's Finance Committee rejected the revenue section of the 2025 budget by a striking 31 votes to 3. Folded into that procedural wreckage were two crypto amendments most of our industry never read. One, backed by the left-wing GDR group and deputy Nicolas Sansu with sixteen co-signers, would treat swaps between MiCA-regulated stablecoins as taxable sales. The other would revive France's exit tax for crypto holders whose portfolios exceed โ‚ฌ800,000. Neither is law yet. Both are signals. And in a market that has spent months chopping sideways โ€” waiting for a direction that refuses to arrive โ€” signals are the only data worth mining.

Here is the context we need to hold. This is not a project, not a protocol, not a token model. It is the tax layer arriving after the regulatory layer. MiCA, the EU's Markets in Crypto-Assets framework, defined the electronic money token and began enforcing its stablecoin rules in June 2024. What France is now doing is the unglamorous second act: writing the domestic tax code that sits beneath that European roof. The stablecoin amendment applies only to tokens qualifying as EMTs under MiCA. The exit tax reaches assets above โ‚ฌ800,000 for taxpayers who have been French residents for at least six of the past ten years. Both would take effect on January 1, 2027.

France already taxes crypto gains at 31.4%, a touch above its standard 30% flat levy. What changes here is not the rate but the surface it covers. And the story has a second voice: deputy Daniel Labaronne has pushed a friendlier amendment allowing losses to be carried forward for a decade โ€” evidence that parliament is not of one mind, and that a genuine tug-of-war between taxation and optimization is underway.

What does the mechanism actually do? Based on my audit experience with lending protocols during the 2022 winter, I've learned to read tax definitions the way I read code โ€” by asking what they touch and what they quietly ignore.

The most consequential change is not a rate. It is a reclassification. By treating a USDC-to-EURC swap as a taxable disposal, the amendment demotes stablecoins from "payment instrument" to "taxable asset." That demotion taxes the medium of exchange rather than the gain. A user who converts one euro-pegged token into another euro-pegged token โ€” ending precisely where they started โ€” may owe tax on a gain they never realized. This bends a principle every tax system claims to hold: you tax profit, not motion.

The whitelist is narrow, and the narrowness is the point. Because the rule covers only MiCA-compliant EMTs, algorithmic and non-compliant stablecoins sit outside its reach. A definitional boundary like this doesn't merely draw a line; it creates a migration path. I have watched this pattern in security education, when a rule meant to protect people simply teaches them which door is unlocked.

France's Stablecoin Swap Tax Is the Post-MiCA Blueprint Nobody Voted For

The โ‚ฌ800,000 threshold tells its own story. It is not a transaction tax. It is a wealth-and-migration tax, aimed squarely at holders with enough capital to leave. Pair it with the six-of-ten-years residency test and you have a defensive instrument โ€” a wall built not against foreign capital entering, but against domestic capital exiting. It echoes, almost word for word, the logic of the American expatriation tax: when wealth becomes mobile, tax authorities follow the person, not the coin.

France's Stablecoin Swap Tax Is the Post-MiCA Blueprint Nobody Voted For

Notice what the text covers and what it leaves untouched. It speaks of custodied assets โ€” the traceable kind an exchange can report and withhold against. Self-custodied wallets remain, for now, beyond the net: not by principle, but by practical admission that you cannot garnish a seed phrase.

Yet the same draft carries a quiet concession: losses may be carried forward for ten years. That clause matters. It tells us the drafters understand crypto holdings can produce genuine, painful losses, and that a system built on "swap equals sale" would otherwise be indefensible. The carryforward is not generosity; it is an admission that the underlying rule is harsh.

Now the part most coverage missed. The 31-to-3 vote was not a verdict on crypto at all โ€” it rejected the budget's revenue section, a broader political rebuke. Reading that number as "France kills crypto tax" is a misread. The amendments do not carry over automatically; supporters must reintroduce them, and the full assembly will debate the government's original text on October 13 and vote on October 20. What we are watching is not legislation. It is positioning.

Set that against the neighborhood. Portugal has spent years softening its once-generous stance; Germany exempts holdings after a year; Singapore and Hong Kong levy no capital gains; the UAE taxes personal income not at all. France is moving in the opposite direction โ€” and in a competition for mobile capital, direction matters more than any single rate.

And here is the blind spot that should worry us most. Taxing stablecoin swaps pushes activity toward self-custody and on-chain DeFi โ€” precisely the venues where no intermediary can withhold or report. A rule designed to bring crypto into the compliant fold may instead scatter it into the shadows, weakening the very KYC and AML visibility that MiCA was built to create. France's real competitor is not Lisbon or Dubai. It is its own enforcement gap.

We have seen this before. In Manila, I helped build a curriculum for small-business owners with local banks, translating compliance into plain language. The lesson was consistent: rules that ignore how people actually behave don't shape behavior โ€” they shape workarounds. Sociologically, a tax that can't be collected doesn't redistribute wealth. It redistributes geography.

So where does this leave us? Two amendments, one effective date three years out, one unresolved vote. This is a slow variable, not a trading catalyst โ€” but it is a blueprint. If France ships a post-MiCA national tax code, other member states will read it, and the continent's tax floor will quietly rise. We didn't come this far to watch the technology of trust be taxed for moving rather than for growing. The question worth carrying into next year is not whether France will tax stablecoin swaps. It is whether we, as a community, will teach the next hundred thousand holders what those words actually mean โ€” before someone else does it for us.
